\u00abDie Trump-Regierung nimmt unsere eingewanderten Freund*innen, Nachbar*innen und Familienmitglieder unverhohlen ins Visier und macht ihr Leben unertr\u00e4glich\u00bb, sagt Amy Fischer, Direktorin f\u00fcr die Rechte von Gefl\u00fcchteten und Migrant*innen bei Amnesty International USA. \u00abMigrant*innen und Schutzsuchende werden im ganzen Land zusammengetrieben, man verweigert ihnen den Zugang zu einem Rechtsbeistand und einem ordnungsgem\u00e4ssen Verfahren, steckt sie in Hafteinrichtungen, in denen Menschenrechtsverletzungen begangen werden, und in eigenen F\u00e4llen verschwinden sie in einem Hochsicherheitsgef\u00e4ngnis in El Salvador. Willk\u00fcrliche Inhaftierung\u00a0

Amnesty International hat zahlreiche F\u00e4lle dokumentiert, in denen Menschen willk\u00fcrlich inhaftiert wurden, unter ihnen Personen, die sich schon seit l\u00e4ngerem in den USA aufhalten oder Asyl beantragt haben. Mehrere Betroffene waren vor politischer Gewalt, Folter und Bandengewalt geflohen. Viele berichteten, dass sie keinen Zugang zu einem Rechtsbeistand hatten, ohne Angabe von Gr\u00fcnden \u00fcber einen l\u00e4ngeren Zeitraum inhaftiert waren, unter grausamen und unmenschlichen Bedingungen leiden mussten und zwischen verschiedenen Einrichtungen hin- und hergeschoben wurden, wodurch es ihnen kaum m\u00f6glich war, mit ihren Angeh\u00f6rigen und Rechtsbeist\u00e4nden zu kommunizieren.\u00a0

Ein Mann aus der Dominikanischen Republik sagte gegen\u00fcber Amnesty International: \u00abIch war innerhalb von zwei Monaten in vier verschiedenen Haftanstalten. Jedes Mal, wenn sie mich verlegen, muss ich einen neuen Prozess durchlaufen, und mein Gerichtstermin, der zust\u00e4ndige Richter und der Status meines Falles \u00e4ndern sich.\u00bb

Andere schilderten die Trennung von ihren Familien, einschliesslich ihrer Ehepartner*innen und Kinder, die ohne Unterst\u00fctzung zur\u00fcckblieben, sie berichteten dar\u00fcber, keinen Kontakt mit ihren Angeh\u00f6rigen zu haben, und von der psychischen Belastung.\u00a0

Fehlende rechtliche Ressourcen

Seit der k\u00fcrzlichen Einstellung des Programms zur rechtlichen Orientierung (Legal Orientation Program) des US-amerikanischen Justizministeriums sind die M\u00f6glichkeiten inhaftierter Personen, sich \u00fcber ihre Rechte zu informieren, stark eingeschr\u00e4nkt. In El Paso haben alteingesessene gemeinn\u00fctzige Organisationen wie Estrella del Paso \u2013 einst ein Rettungsanker f\u00fcr Migrant*innen, weil sie in der Haft Schulungen zum Einwanderungsrecht und zum Rechtssystem durchf\u00fchrten und unbegleitete Minderj\u00e4hrige vor Gericht unterst\u00fctzten \u2013 ihre Finanzierung verloren. Migrant*innen wird dadurch der Zugang zu einem Rechtsbeistand und die Gew\u00e4hrleistung f\u00fcr ein ordentliches Verfahren enorm erschwert. Die meisten der befragten inhaftierten Personen hatten keinen Rechtsbeistand, regelm\u00e4ssig wurde ihnen auch der Zugang zur Rechtsbibliothek verweigert.

Ein Dienstleister aus diesem Bereich sagte: \u00abMan sorgt absichtlich daf\u00fcr, dass die Leute scheitern.\u00bb

Unmenschliche Haftbedingungen

Im Rahmen der Anwendung des Alien Enemies Act durch die US-Regierung werden Venezolaner*innen unverh\u00e4ltnism\u00e4ssig oft ins Visier genommen und ohne Beweise zu Mitgliedern einer Bande erkl\u00e4rt, willk\u00fcrlich inhaftiert und ohne ein ordentliches Verfahren abgeschoben, unter anderem nach El Salvador, wo sie unmenschlichen Haftbedingungen und der Gefahr von Folter ausgesetzt sind. In der EPSPC-Hafteinrichtung berichteten Personen, dass Venezolaner*innen unverh\u00e4ltnism\u00e4ssig oft von Gef\u00e4ngnispersonal k\u00f6rperlich misshandelt, in Einzelhaft gesteckt und allein aufgrund ihrer Nationalit\u00e4t oder ihrer T\u00e4towierungen als \u00abausl\u00e4ndische Feinde\u00bb bezeichnet werden.\u202fIn anonymen Gespr\u00e4chen schilderten verschiedene inhaftierte Personen, dass das Wachpersonal ihnen gedroht habe, sie nach Guant\u00e1namo oder El Salvador zu schicken, um sie einzusch\u00fcchtern und/oder zu disziplinieren.\u202f\u202f\u00a0

Eine im EPSPC inhaftierte Person aus Venezuela berichtete Amnesty International: \u00abEin Mann wurde vom Wachpersonal zu Boden geworfen und geschlagen und dann nach El Salvador geschickt, weil er jemanden in der Essensschlange \u00fcbersprungen hatte. Ein anderer Venezolaner wollte nur mit dem Wachpersonal sprechen und kam dann mit v\u00f6llig zerschlagenem Gesicht zur\u00fcck.\u00bb\u00a0

Die Recherchen von Amnesty International haben ergeben, dass die Haftbedingungen im EPSPC-Haftzentrum sowohl gegen US-amerikanische als auch gegen internationale Haftstandards verstossen. Im EPSPC inhaftierte Personen berichteten \u00fcber k\u00f6rperliche Misshandlungen durch das Wachpersonal, Einzelhaft, unhygienische und \u00fcberf\u00fcllte Wohnbereiche einschliesslich defekter Toiletten, eine unzureichende medizinische Versorgung und minderwertige, abgelaufene Lebensmittel.\u00a0\u00a0

Viele der Inhaftierten, mit denen Amnesty International sprach, hatten \u00e4hnliche Erfahrungen gemacht. Eine Person erz\u00e4hlte Folgendes: \u00abWir haben keinen Zugang zu der ben\u00f6tigten medizinischen Versorgung. Sie haben uns abgelaufene Lebensmittel zu essen gegeben, und wir sind alle krank geworden. Sie haben uns gesagt, wir sollten Wasser trinken. Das Wasser ist warm und nicht sauber. Es riecht unangenehm. Sie haben uns keine Medikamente gegeben.\u00bb

Illegitime Einwanderungspolitik

\u00abDie Regierung unter Pr\u00e4sident Trump h\u00e4lt Menschen fest und f\u00fchrt Massenabschiebungen durch, ohne auf Menschenrechte, W\u00fcrde oder Verantwortlichkeit zu achten\u00bb, sagt Amy Fischer. \u00abDas ist keine funktionierende Einwanderungspolitik \u2013 das ist ein massiver Angriff gegen migrantische Gemeinschaften, bei dem Grausamkeit als Waffe eingesetzt wird, um Menschen dazu zu bringen, ihre Rechte aufzugeben und f\u00fcr ihre eigene Abschiebung zu sorgen.\u00bb

Die US-Regierung unter Pr\u00e4sident Donald Trump fordert unterdessen \u00fcber 200\u00a0Milliarden US-Dollar, um ihre Kapazit\u00e4ten bei der Durchsetzung der Einwanderungsgesetze zu erweitern \u2013 darunter 45\u00a0Milliarden US-Dollar, um die derzeitige Inhaftierungskapazit\u00e4t auf 150\u2018000\u00a0Menschen t\u00e4glich zu verdreifachen.\u00a0

Amnesty International fordert die US-Regierung auf, die massenhafte Inhaftierung von Migrant*innen zu beenden, bei jeder Inhaftierung eine individuelle Beurteilung unter Zugrundelegung des Rechts auf Freiheit zu gew\u00e4hrleisten, ein garantiertes Recht auf einen Rechtsbeistand einzuf\u00fchren und internationale Menschenrechtsstandards konsequent einzuhalten. Ausserdem muss sie die gezielte Abschiebung von Venezolaner*innen unter strikter Einhaltung des Grundsatzes des Non-Refoulements einstellen.

Der Kongress muss die Finanzierung von Inhaftierungs- und Abschiebesystemen, die gegen die Menschenrechte verstossen, einstellen. Die Regierung muss Abschiebungen nach dem Alien Enemies Act stoppen, Betroffenen ein ordnungsgem\u00e4sses Verfahren und eine sichere R\u00fcckkehr garantieren und sicherstellen, dass alle Personen, die vor ein Einwanderungsgericht kommen, rechtzeitig Zugang zu einem Rechtsbeistand erhalten.\u00a0

\u00abDer Kongress muss die Vergabe weiterer Geldmittel f\u00fcr die Ausweitung dieses grausamen Systems ablehnen\u00bb, sagt Fischer. \u00abUnabh\u00e4ngig davon, was Pr\u00e4sident Trump sagt, haben die Vereinigten Staaten die Pflicht, die Menschenrechte aller Menschen innerhalb ihrer Grenzen zu wahren.
